Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of Zetver, a software-as-a-service (SaaS) product operated by Zetver ("Zetver", "we", "us") through the website zetver.com and its related web applications (together, the "Service").

Zetver is a business-management tool — a micro CRM that helps studios and classes run QR check-ins, attendance, memberships, customer records, payment tracking and a customer portal. Zetver is not an e-commerce store and does not sell physical products.

By creating an account, subscribing to a plan, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Zetver accounts are for businesses — such as yoga studios, gyms, dance and fitness classes, martial arts schools and similar businesses — and their authorised staff. You must be at least 18 years old and able to form a binding contract to create an account.

You are responsible for:

• The accuracy of the registration information you provide (business name, owner name, email, phone, city).
• Safeguarding the passwords and credentials of your account and of every staff member you add, and for all activity that happens under your account.
• Promptly informing us of any unauthorised access or security incident you become aware of.

You may add staff members to your business account and control their access through the staff settings in the Service. Staff access can be edited or removed by the account owner at any time.

Every new business account starts with a 14-day free trial. No payment method is required to sign up, and no charges apply during the trial. Billing begins only after a paid subscription is activated for your account.

Current plans and prices are published on the Pricing section of zetver.com. Prices are shown in Indian Rupees (₹) and are per business location per month unless stated otherwise. Applicable taxes may be added where required by law.

• Subscriptions are billed in advance on a monthly basis for the plan you select.
• You may cancel your subscription at any time; see our Cancellation & Refund Policy for details.
• We may change plan prices prospectively. Any price change will be communicated before it applies to your next billing period.

If a payment for your subscription fails or remains unpaid, we may contact you and, if it remains unresolved, suspend or downgrade the account as described in section 7.

You agree to use the Service only for lawful business purposes. You must not:

• Use the Service to violate any applicable law or the rights of any person.
• Attempt to gain unauthorised access to the Service, other businesses' data, or related systems; probe, scan or test the vulnerability of the Service; or bypass any authentication or security measure.
• Interfere with or disrupt the integrity or performance of the Service, including by transmitting malicious code or imposing unreasonable load.
• Resell, sublicense or offer the Service as your own product to third parties without our prior written agreement.
• Misrepresent Zetver as endorsing you, or use our name and logo in a way that suggests a partnership that does not exist.

You are responsible for how your staff and, where you enable it, your customers use the Service within your business account.

You enter and manage your own records in Zetver — your plans, your customers, their attendance and their payments. You remain the controller of that information and are responsible for:

• Having a lawful basis (such as your customers' consent) to collect and record their personal information in Zetver.
• The accuracy and legality of the customer information you enter.
• Handling your customers' requests about their data, memberships and payments.

We process your business data only to provide, secure and support the Service, as described in our Privacy Policy. Businesses on Zetver are isolated from each other; your records are not visible to other businesses.

Zetver includes tools that let you record and track payments from your own customers, and, where you enable a payment gateway, accept online payments. Those amounts are between you and your customers.

Zetver is not a merchant of record for, a party to, or a refund guarantor of the transactions between your business and your customers. Where a payment gateway is used, the gateway processes the payment as an independent payment service provider, and its own terms apply to that processing. Refunds of your studio's services are your responsibility as described in our Cancellation & Refund Policy.

We work to keep the Service available and may release updates, change features, or discontinue individual features over time. Unplanned downtime can happen; if we plan significant changes that materially reduce core functionality of a paid plan, we will communicate them in advance where reasonably possible.

You may stop using the Service and cancel your subscription at any time.

We may suspend or restrict the Service if: (a) required payments are overdue after notice; (b) you materially breach these Terms and do not remedy the breach after notice; or (c) we are legally required to do so, or to protect the security of the Service or other businesses.

If your account ends, your ability to access records through the Service ends with it. On request before closure, we will make reasonable efforts to let you export your business data; after closure, data is deleted in line with our Privacy Policy, except where retention is legally required.

Zetver, including its software, design, brand, name, logo and content, is owned by Zetver and protected by applicable intellectual-property laws. Except for the rights expressly granted to you in these Terms, no rights in the Service are transferred.

You keep all rights to the business data and customer records you enter into the Service. You grant us a limited licence to host and process that data solely to operate and support the Service for you.

If you send us feedback or suggestions, you allow us to use them to improve the Service without obligation or attribution.

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, Zetver will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, arising from your use of the Service.

Our total liability for any claim relating to the Service is limited to the subscription fees you paid to us for the Service in the three (3) months immediately before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

These Terms are governed by the laws of India. The courts of India have jurisdiction over disputes arising from these Terms, without prejudice to mandatory consumer-protection rights where you are a consumer.

We may update these Terms from time to time. The current version is always published on this page with its "last updated" date. For material changes that affect paid subscribers, we will also provide reasonable notice, such as by email or a notice in the Service. Continuing to use the Service after changes take effect means you accept the updated Terms.
